TERMS OF USE

1. Purpose and Scope

The Demo Environment is provided solely for the limited purpose of demonstrating the functionality and capabilities of Cyberbay's human risk simulation technology in a controlled, non-production setting.

The Demo Environment:

• is made available strictly for demonstration and evaluation purposes;
• does not constitute a production-grade security service;
• does not provide real phishing simulation, penetration testing, or security testing services;
• does not constitute legal, regulatory, or cybersecurity advice;
• must not be relied upon for operational, compliance, or risk management decisions; and
• does not create any binding service obligation or commercial engagement.

All outputs, simulations, and results generated within the Demo Environment are illustrative in nature only.

2. Information Submitted by Users

In order to facilitate the demonstration, you may be requested to provide certain limited information, which may include:

• name;
• business email address (optional);
• telephone number;
• voice samples or recordings (optional); and
• scenario inputs or configuration selections.

You represent and warrant that any information submitted is accurate and that you have all necessary rights, authority, and permissions to provide such information.

3. Purpose Limitation and Data Use

Cyberbay shall process information submitted through the Demo Environment solely for the purpose of delivering and facilitating the requested demonstration.

To the fullest extent permitted by applicable law, Cyberbay shall not use such information for:

• marketing or promotional communications;
• sales outreach or lead generation;
• customer relationship management enrichment;
• profiling or behavioral analysis unrelated to the demonstration;
• third-party disclosure, sale, or commercialization; or
• training of artificial intelligence models, unless expressly disclosed at the point of collection.

Participation in the Demo Environment does not constitute consent to receive marketing communications.

All information submitted shall be treated as demonstration data.

4. Consent to Simulation Interaction

By submitting a telephone number and initiating a simulation, you expressly request and consent to receiving a demonstration call, which may be automated and/or generated using artificial intelligence systems.

You acknowledge and agree that:

• the call is part of a controlled product demonstration;
• the call does not constitute commercial solicitation; and
• no follow-up communication will occur unless separately requested by you.

You further represent and warrant that:

• you are the subscriber of, or are duly authorized to use, the submitted telephone number; and
• you understand that the interaction is simulated and does not represent a real-world communication.

Such consent is limited solely to the requested demonstration.

5. Voice Data and Audio Processing

Where voice functionality is utilized, Cyberbay may process:

• uploaded voice samples;
• synthetically generated voice outputs; and
• transcripts or recordings of interactions.

You represent and warrant that you have all necessary rights and permissions to upload or use any voice data submitted.

You acknowledge that:

• generated voice outputs are algorithmic approximations and may not accurately reflect any individual; and
• Cyberbay makes no representation as to the accuracy or likeness of any generated voice.

To the fullest extent permitted by law, Cyberbay disclaims any liability arising from:

• unauthorized use of voice data;
• disputes relating to identity or likeness; or
• misuse of generated audio content.

Voice data shall not be used for model training unless expressly disclosed.

6. Data Retention

Data submitted within the Demo Environment is intended to be transient in nature.

Cyberbay may retain such data temporarily for purposes including:

• operation of the demonstration;
• system performance and reliability;
• security monitoring and abuse prevention; and
• technical diagnostics.

Cyberbay does not guarantee data persistence. Data, including voice samples and interaction records, may be deleted, anonymized, or purged at Cyberbay's discretion.

The Demo Environment must not be used as a data storage solution.

7. User Obligations

You agree that you shall:

• submit only information you are authorized to provide;
• refrain from submitting sensitive personal data, confidential information, or regulated data; and
• obtain all necessary consents prior to submitting any third-party information.

You further agree not to use the Demo Environment to:

• conduct real phishing or social engineering activities;
• test individuals without their knowledge and consent;
• harass, mislead, or deceive any person;
• initiate real-world outreach or campaigns; or
• misuse the system in any manner.

Cyberbay disclaims all liability arising from user misuse.

8. Acceptable Use and Restrictions

You shall not:

• attempt to gain unauthorized access to the Demo Environment;
• perform security testing, probing, or vulnerability scanning;
• reverse engineer, decompile, or extract underlying methodologies;
• record, reproduce, or distribute demonstrations without authorization;
• use automated tools, scraping, or extraction mechanisms; or
• use the Demo Environment for competitive benchmarking without prior written consent.

Cyberbay reserves the right, at its sole discretion and without notice, to monitor usage, restrict access, suspend functionality, or terminate access.

9. No Security or Performance Guarantee

The Demo Environment does not provide, and shall not be construed as providing:

• security protection or threat detection;
• risk assessment or validation;
• compliance verification; or
• assurance of real-world attack effectiveness.

You agree not to rely on any outputs for security, operational, or compliance decisions.

10. Disclaimer of Warranties

The Demo Environment is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Cyberbay disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of:

• accuracy;
• reliability;
• availability;
• fitness for a particular purpose; and
• non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Cyberbay shall not be liable for any:

• indirect, incidental, or consequential damages;
• loss of business, revenue, or opportunity;
• data loss or corruption;
• reputational harm; or
• decisions made in reliance on the Demo Environment.

Your use of the Demo Environment is at your sole risk.

12. Intellectual Property

All rights, title, and interest in and to the Demo Environment, including all underlying technology, methodologies, and materials, remain the exclusive property of Cyberbay.

Nothing in these Terms grants you any license or right to:

• reproduce, distribute, or commercialize any aspect of the Demo Environment; or
• access or use underlying technology beyond the limited demonstration.

13. Regulatory Disclaimer

The Demo Environment:

• is not a compliance solution;
• does not provide certification or audit evidence;
• does not validate adherence to any regulatory framework (including ISO, SOC, or NIST); and
• does not replace professional security or compliance assessment.

14. Indemnification

You agree to indemnify, defend, and hold harmless Cyberbay from and against any claims, damages, liabilities, and expenses arising out of or related to:

• your misuse of the Demo Environment;
• unauthorized or unlawful data submission;
• violation of applicable laws or regulations; or
• third-party claims arising from your participation.

15. Modifications

Cyberbay reserves the right to modify, suspend, or discontinue the Demo Environment, or to update these Terms, at any time and without prior notice.

Continued use constitutes acceptance of any updated Terms.

16. Acknowledgment

By proceeding, you acknowledge and agree that:

• the Demo Environment is for demonstration purposes only;
• no production services are being provided;
• submitted data is used solely for demonstration;
• no marketing consent is implied;
• you are authorized to provide all submitted information; and
• Cyberbay disclaims liability to the fullest extent permitted by law.
